The Supreme Court has ruled this afternoon (Friday) that Victoria’s brumby cull can go ahead.
Omeo cattleman Philip Maguire took the case to court in a bid to stop the culling of brumbies in the state’s eastern alps, however Justice Stephen Moore has ruled that Parks Victoria was not required to consult with the community about the cull by ground shooting of feral horses in the area. According to The Age, Justice Moore said Mr Maguire did not have the standing to bring the proceeding and dismissed the case.
However, despite the setback, Mr Maguire plans to appeal the decision and seek an injunction to temporarily halt the cull.
Mr Maguire’s lawyers asked Justice Moore to draft an interim injunction to prevent the horses from being shot until they were able to take the matter to the Court of Appeal.
The Age has reported that Parks Victoria have said that no animals would be shot before next Thursday.
